This policy is part of the Terms of Service. It applies to the Client, its Users and its Subaccounts, and to any content published or sent through Nod, including landings, forms, portal, emails, automations and integrations.
1. Prohibited activities
You cannot use the Platform to:
Illegal or harmful activities
- Any illegal activity, or the sale or promotion of illegal products or services.
- Frauds, scams, pyramid schemes or deceptive financial products.
- Impersonate the identity of another person or organization.
- Harass, threaten, discriminate, or incite hatred or violence.
- Content that exploits or harms minors.
- Explicit sexual content or sexual services.
- Violate intellectual, industrial, image or privacy property rights of third parties.
Communications and data
- Send unsolicited commercial communications (spam) or without the consent required by the LSSI-CE and the applicable regulations.
- Send emails to purchased, rented or collected lists without consent.
- Ignore recipients' unsubscription requests.
- Collect or process personal data without legal basis or without informing the interested parties.
- Process special categories of data, such as health data, without legal basis and adequate guarantees.
- Impersonate entities or websites to obtain passwords, banking or payment details (phishing).
Advertising and claims
- Publish landing pages or advertisements with false or misleading claims, in particular promises of guaranteed income, medical cures or results that cannot be justified.
- Violate the advertising policies of Meta, Google or other connected services.
Security and technical abuse
- Try to access data or spaces of other clients, circumvent permissions or security measures.
- Test, scan or exploit vulnerabilities without written authorization from Nod.
- Introduce viruses, malware or harmful code.
- Deliberately overload the Platform or third-party APIs, circumvent usage limits, or perform automated bulk extractions.
- Reverse engineer, copy or resell the Platform.
Integrations
- Use data obtained from Google, Meta or other connected services in a manner contrary to their conditions and policies.
- Connect third-party accounts that you are not the owner of or for which you do not have authorization.
2. Customer Content
The Client is solely responsible for the content that he publishes, sends or stores on the Platform and the products and services that he sells through it.
3. Consequences of non-compliance
If we detect or are notified of a possible breach, we may, depending on the severity and without prejudice to other actions:
- Ask you to remove the content or correct the behavior.
- Unpublish landing pages or forms, or suspend sending emails.
- Temporarily or permanently suspend access to the Space or certain functions.
- Terminate the contract in accordance with the Terms of Service.
- Communicate the facts to the competent authorities when appropriate.
4. How to report abuse
If you detect use contrary to this policy, write to us at hello@thenodai.com with the available information, such as the landing address or a copy of the email received. We will review each communication.
Communications and identity
Customers must comply with the notices, permissions, consents, and opt-out mechanisms required for each channel and country. Connecting an integration does not establish recipient consent. Impersonation, falsely attributing statements to another person, and concealing an automated interaction where disclosure is required are prohibited.
Commercial email must accurately identify the sender, avoid misleading subject lines, and include a postal address and unsubscribe mechanism where required by law. Opt-out requests and connected-service rules must be honored. These obligations supplement applicable GDPR requirements and Spanish rules on commercial communications.
